A court in Nairobi has set free a man who was charged over claims that he killed his wife after finding her in bed with another man who was their neighbour.
The man had appealed a death sentence and in their ruling three judges who heard his case concluded that the man was reactive after busting his wife in the act.
The court also heard that the prior to the incident the man had been calling his wife but she was not picking.
The incident happened in 2013 around Industrial area in Nairobi.
After all the witnesses had testified, the man gave his side of the story. He recalled that on the fateful day he was planning to move out of the neighbourhood with his wife.
Around that time, the man told the court he had gone out to look for transport and when he came back, their house was locked.
This forced him to go a neighbour to request for power to charge his phone only to find his wife in the act yet she had earlier claimed she was going to visit someone.
The court heard that in rage, the man reached to the bed where his wife was laid and amid the scuffle between him and the man who was in bed with his wife.
Amid the struggle between the two men, it was stated the deceased was accidentally stabbed.
The appealant told the court that he had no intention of killing his wife.
Thus, the court ruled, “He was so enraged that he attacked both of them and ended up stabbing the deceased to death,” the bench ruled.
The court further stated that the prosecution did not prove the case beyond reasonable doubt.
