The recently rejected Nairobi County Secretary Jairus Musumba is not going anywhere, at least for now.
A court in Nairobi has issued statutory orders allowing Musumba to stay office until March 8 when the case will be heard.
The court also set aside the decision by the County Assembly directing Governor Johnson Sakaja to appoint another candidate in a period of seven days.
The Court further ordered the Speaker and the County Assembly to retable the second report on the vetting of Musumba for the position of the County Secretary under strict adherence to the laid down procedures.
“The pending hearing and determination of this application, this honourable Court be pleased to issue interim conservatory orders suspending the tabling, debating and considering and / or acting upon the report of the nominee for the position of County Secretary by MCA,” Justice Chigiti ordered.
The assembly rejected the appointment of Musumba, stating that he was unqualified and had been in office illegally.
The rejection came hours after Musumba appeared for a vetting session before assembly select committee on appointments.
Majority leader Peter Imwatok told the house, Musumba, who was appointed by Governor Sakaja, was not fit for the office based on his responses during the vetting, among other crucial queries
The motion to reject Musumba was supported by the majority of the members among them Minority leader Anthony Kiragu, who said the vetting team made unanimous decision so as to save the city residents from unfit individuals.
The Assembly was told Musumba had been in the office illegally and drawing salaries.
