A couple has been charged with tax fraud of KShs 258,279,064 at the Nyeri Chief Magistrate’s court.
Samson Kanihu Gathiru and Harrieth Ludwina Gathuru, both directors of Imenti Springs Ltd, were charged before Senior Resident Magistrate Hon. Mary Makena where they jointly and separately faced a total of ten counts of fraud in Relation to Tax contrary to Section 97 (a) as read with Section 104(3) of The Tax Procedures Act No. 29 Of 2015.
The two directors were actively engaged in a multi-million business but failed to declare in their income tax and Value Added Tax returns the correct income earned from 2016 to 2020 leading to massive tax loss.
Taxpayers are obligated under the law to declare their accurate income to the Commissioner. The company failed to declare Sh567,246,362 resulting to a revenue loss in both corporate income tax and VAT of Sh254, 018,691.
Harrieth, who was the only one present in court, denied all the charges and was released on a bond of Sh2 million. Summons were issued for Kanihu who is separately facing additional charges of failing to declare income in his returns resulting to a revenue loss of Sh4,260,373
The case will be mentioned on 11th November, 2024 where Kanihu is expected to appear in court.
