The Director of Public Prosecutions (DPP) has formally approved criminal charges against a state counsel following completion of graft charges against him
Samuel Mugo Kiarie, a prosecutor who was then attached at the Makadara Law Courts in Nairobi, during the time of alleged bribery claims in the year 2023.
In a statement issued, the Office of the Director of Public Prosecutions (ODPP) confirmed that it received an inquiry file from the Ethics and Anti-Corruption Commission (EACC) concerning the matter.
After conducting an independent and thorough review of the evidence, the DPP established that there is sufficient and credible evidence to sustain prosecution.
The DPP has consequently directed that Mr Kiarie be charged with three counts of receiving a bribe, contrary to Section 6(1) as read with Section 18 of the Bribery Act.
He is to be arraigned before a court of competent jurisdiction to face the charges. The ODPP emphasised that the decision underscores its unwavering commitment to accountability within the justice sector.
“No individual, regardless of office, rank or position, is above the law,” the statement read.
“The Office of the Director of Public Prosecutions will not hesitate to take decisive action against any officer who undermines the integrity of the Criminal Justice System.”
The ODPP further reaffirmed its dedication to discharging its constitutional mandate in line with the rule of law, public interest, and the fair administration of justice.
