About two years since Deputy President Kithure Kindiki was sworn in, a petition challenging his removal is pending in court and will be heard on 29, September 2026.
Kindiki was named as second in command by President Ruto following successfull impeachment of former Deputy President Rigathi Gachagua.
But immediately Kindiki took an aoth of office Kenyan Enock Aura moved to court to challenge Kindiki’s swearing-in citing that it was unconstitutional.
The businessman, through lawyer Harrison Kinyanjui, is seeking orders to have Kindiki removed from office.
He argues that the process through which he assumed the Deputy Presidency following the impeachment of former Deputy President Rigathi Gachagua raises fundamental constitutional questions.
Among the issues before the court is Aura’s contention that Kindiki had not formally resigned from his position as Cabinet Secretary for Interior before assuming the office of Deputy President.
He wants the court to determine whether his appointment and swearing-in complied with the Constitution.
The petition was filed in October 2024 following Gachagua’s impeachment and President William Ruto’s nomination of then Interior CS Kithure Kindiki as his replacement.
The matter will be heard by a three-judge bench comprising Justices Eric Kennedy Ogola, Fredah Mugambi and Anthony Mrima.
